ARTICLE X
SCHEDULES AND CANCELLATION OF FLIGHTS

Section 1. – Schedules. 

A. SEAIR undertakes to use its best efforts to carry the passenger and his baggage with reasonable dispatch and to adhere to published schedules in effect on the date of travel.  However, no particular time is fixed for the commencement or completion of carriage and times shown in the ticket, timetables or elsewhere are approximate and not guaranteed, and do not form part of the Conditions of Carriage.  Schedules are subject to change without notice and SEAIR assumes no responsibility or liability for any loss incurred by passengers as a result of such change.

B.  SEAIR may, without notice to the passengers, substitute alternative carriers or aircraft.

Section 2. – Cancellation, Changes of Schedule, etc.  At any time after a booking has been made, SEAIR may change flight schedule and/or cancel, terminate, divert, postpone, reschedule or delay any flight where SEAIR may consider this to be justified by circumstances beyond its control or for reasons of safety or commercial reasons.  In such cases, SEAIR shall not be liable to the passenger for any indirect, special or consequential loss, expense or damage, including loss of income.  In the event of such flight cancellation or changes to the schedule, SEAIR at its option, may either:

1.    Carry the passenger at the earliest opportunity on another of its scheduled passenger services on which space is available without additional charge and, when necessary, extend the validity of the passenger’s booking; or
2.    Reroute the passenger to the destination indicated on the ticket or applicable portion thereof by its own scheduled services or the scheduled service of another carrier, or by means of surface transportation; or
3.    Allow the passenger to retain the value of the fare in a credit account for future travel provided that the passenger must rebook a flight with SEAIR using the credit within six (6) months therefrom; or
4.    Make a refund in accordance with this Conditions of Carriage and shall be under no further liability to the passenger.

Upon occurrence of the events stated in this Section, the options outlined in this Section are the sole and exclusive remedies available to the passenger and SEAIR shall have no further liability to the passenger.
