LIABILITY FOR BAGGAGE AND EXCESS BAGGAGE VALUATION
LIMITS ON LIABILITY FOR BAGGAGE, INCLUDING FRAGILE OR PERISHABLE GOODS, AND AVAILABILITY OF EXCESS VALUATION
Section 1 - Domestic Baggage Claim Limits and Procedures
- SEAIR’s liability for loss, damage or delay in delivery of baggage in its custody shall not exceed Php 40.00 per kilo.
- When wheelchairs or other assistive devices are disassembled by SEAIR for stowage, it shall reassemble them and ensure their prompt return to the disabled passenger. Wheelchairs and other assistive devices shall be returned to the passenger in the condition received by SEAIR.
- With respect to domestic transportation, the baggage liability limits of 14 CFR, part 354, do not apply to liability for loss, damage, or delay concerning wheelchairs or other assistive devices. The criterion for calculating the compensation for a lost, damaged, or destroyed wheelchair or other assistive device shall be the original purchase price of the device.
- SEAIR shall not require qualified individuals with a disability to sign waivers of liability for damage to or loss of wheelchairs or other assistive devices.
NOTE: ALL CLAIMS ARE SUBJECT TO PROOF OF VALUE AND LOSS
- When SEAIR has exercised the ordinary standard of care, it shall not be liable for delay in delivery of any perishables, nor for damage to or damage caused by fragile items, liquids or perishables which are unsuitably packed and which are included in a passenger's checked baggage with or without SEAIR's knowledge. SEAIR may allow a passenger to check fragile and/or perishable items that are unsuitably packed upon the execution of a limited liability release tag.
- SEAIR is not responsible for jewelry, cash, photographic or electronic equipment, silverware, negotiable papers, securities, business documents, samples, paintings, antiques, artifacts, manuscripts, furs, irreplaceable books, or publications and similar valuable items contained in checked or unchecked baggage. If any of these items are lost, damaged or delayed, the passenger will not be entitled to any reimbursement.
- SEAIR is not responsible for normal wear and tear to checked baggage.
- SEAIR will not be liable or responsible for property carried on board an aircraft by a passenger and retained in their custody.
- Any exclusion or limitation of liability of SEAIR shall apply to and be for the benefit of agents, servants and representatives of SEAIR and any person whose aircraft is used by SEAIR for carriage and its agents, servants and representatives.
Section 2 - International – Notice of Baggage Liability Limitations
For most international travel (including domestic portions of international journeys):
- Liability for loss, delay, or damage to baggage is limited to approximately Php40.00 per kilo for checked baggage and Php500.00 per passenger for unchecked baggage unless a higher value is declared in advance and additional charges are paid. Excess valuation may not be declared on certain types of valuable articles. Carriers assume no liability for fragile or perishable articles. Further information may be obtained from the carrier.
- Liability is for a maximum of 10 kilos (Php800.00) per checked bag. The limit may be lowered for additional pieces to certain destinations or when using connecting carriers.
Section 3 - General Conditions of Acceptance
- SEAIR will accept for transportation as baggage such personal property as necessary or appropriate for wear, use, comfort or convenience of the passenger for the purpose of the trip.
- All baggage is subject to inspection. Checked baggage will be accepted for transportation only on flights on which the passenger is traveling. SEAIR will not accept baggage whose size, weight or character makes it unsuitable for transportation on the aircraft as determined by SEAIR. Baggage items must be suitably packaged to withstand normal handling as checked baggage or they may be refused. Acceptance of any baggage does not constitute agreement by SEAIR that such baggage is suitably packed.
- SEAIR will not accept live animals as checked baggage.
- SEAIR will check baggage for a passenger with a valid confirmation subject to the following conditions:
- Baggage must be checked at the airport in advance of flight departure.
- The passenger's name must appear on the outside of the baggage.
- Baggage will only be checked:
- To an airport that is on the passenger's routing
- To the passenger's next airport of stopover
- To the passenger's final destination airport
- Due to security requirements, passengers and their baggage will not be accepted at the ticket counter less than 30 minutes prior to the scheduled departure of their flight. Please note the minimum check-in time for passengers with checked baggage may be greater than 30 minutes at some airports. The minimum check-in time for baggage at each SEAIR station is available at SEAIR ticket offices:
- Checked baggage may be claimed only by the holder of the baggage claim check. Baggage claim checks must be returned to SEAIR on request. SEAIR is not responsible to determine that the holder of the claim check is entitled to the baggage. If baggage claim checks are lost, proof of ownership may be required prior to release of the baggage.
- Acceptance of baggage by the bearer of a claim check without filing a written complaint shall constitute evidence of delivery by Air Tran of the passenger's baggage, with all original contents, in good condition.
- Baggage is measured by length + width + height. The dimensions of each measurement are added together to compose the total number of linear inches.
- Baggage Allowance
Section 4 - Free Baggage Allowance
- Customers traveling on SEAIR are allowed one (1) piece of checked baggage plus one (1) carry-on bag free of charge provided they meet size and weight limitations. The maximum weight per checked bag is 10 kilos and the maximum size is 59 inches (length + width + height). Certain items, such as skis and golf bag, will be accepted as one item under the free baggage allowance.
- Military Personnel may check one (1) Duffle Bag or Sea Bag in place of a 59 inch bag.
Section 5 - Excess Baggage
Checked baggage in excess of the free baggage allowance will be charged at the rate of $50 per bag.
Section 6 - Overweight Baggage
Checked baggage weighing from 21 to 40 pounds will accepted as checked baggage subject to an excess weight charge of Php 500.00 per piece and baggage that weighs 41 to 50 kilos will be accepted subject to an excess weight charge of $1,000.00 per piece. Baggage in excess of 50 kilos will not be accepted.
Section 7 - Oversize Baggage
Checked baggage with overall dimensions from 60 inches to 80 inches will be assessed a per piece charge of Php 500.00. Baggage in excess of 80 inches will not be accepted.
Section 8 - Special items such as bicycles, surfboards, and scuba equipment are not included in a passenger's free checked baggage allowance and are subject to a Php500.00
charge.
Section 9 - Wheelchairs and assistive devices will be carried free of charge for qualified disabled passengers, and are not included in the free checked baggage allowance described above.
Section 10 - Carry-On Baggage
- The suitability of carry-on baggage will be determined by SEAIR. Each passenger may carry on, without charge, one (1) bag totaling no more than 30 inches in overall dimensions. The bag must be stowed under the seat in front of the passenger or in an approved overhead bin. Garment bags are considered one of the allotted pieces.
- Any mobility aid or assistive device that is approved for in-cabin transport on SEAIR, which is carried by a qualified passenger with a disability, is not subject to the one piece carry-on limit, provided such aid or device fits in an approved storage space.
- All baggage must be completely stowed before the airplane may depart the gate. Further information is available at any facility.
Section 11 - Fragile and Perishable Items
- Fragile items will be accepted if they are appropriately packaged in an original factory-sealed container, in a case designed for shipping such items, or packed with airline-approved, protective material. Fragile items without appropriate packaging will be accepted only upon the execution of a release, furnished by SEAIR, which indemnifies SEAIR against liability for damage to, loss or spoilage of contents, or delay in delivery resulting in damage to, loss or spoilage of such items.
- SEAIR will refuse to accept property for transportation that is not suitably packaged to withstand ordinary handling, the size, weight or character of which makes it unsuitable for transportation, or that cannot be accommodated without harming or annoying passengers.
Section 12 - Restricted Articles
- Hazardous materials will not be accepted as baggage except for medical/toilet articles for personal use, minimal amounts of small arms ammunition if properly packaged, scuba tank with less than 40 PSI, transport incubator, limited amounts of dry ice and wheelchair batteries. All such material must comply with rules established by SEAIR.
- The following articles are classified as hazardous and must not be carried in baggage:
- Compressed gasses.
- Corrosives, such as acids and spill able wet cell batteries.
- Explosives, such as fireworks and ammunition.
- Flammables, such as matches and lighter fuels.
- Poisons.
- Oxidizers.
- Magnetic and radioactive materials and all other items restricted by government regulations.
Section 13 - Conditions for Acceptance of Special Items
The following are special items that will be accepted as checked or carry-on baggage, subject to specified conditions and payment of charges when applicable:
- Firearms - In accordance with Federal Regulations, a passenger who presents baggage containing a firearm must sign a declaration that the firearm is unloaded and placed in a suitable container before such baggage will be checked. Ammunition must be securely packed in durable fiber, wood, metal boxes or in the manufacturer's original containers. No ammunition may be packed in the same container as the firearm. Baggage containing handguns must be locked with a key or lock combination in possession of the passenger only, and the bag must be of the hard-side type.
- Seat Baggage -When determined acceptable by SEAIR, an item of baggage may occupy a seat (Bulkhead seat only), providing the passenger accompanies the property, the item meets specified dimensions, can be properly secured by the seat belt, reservations are made and the applicable fare is paid.
